1. Agreement to these Terms

By visiting https://www.apexgymnv.com/, contacting Apex, requesting a tour or free week trial, purchasing a membership, punch card, drop-in, personal training, sauna session, or otherwise using Apex facilities or services, you agree to these Terms and Conditions (“Terms”) and our Privacy Policy.

If you do not agree, do not use our website or services.

## 2. Who these Terms cover

These Terms apply to website visitors, prospective members, trial participants, members, guests, and anyone using Apex services, including:

  • CrossFit classes

  • HYROX training

  • Powerlifting

  • Strongman

  • Olympic weightlifting

  • Personal training

  • Open gym

  • Traditional steam sauna

  • Related coaching, events, and facility access (including any after-hours / 24-hour access we may offer to eligible members)

Parents or legal guardians are responsible for minors who train at Apex and must complete any required waivers and consents.

3. Website use

You may use our website for lawful, personal purposes related to learning about Apex and contacting us. You agree not to:

  • Misuse forms, scrape content in a harmful way, or attempt unauthorized access to systems

  • Submit false or misleading contact information

  • Interfere with the site’s operation or security

Website content (text, logos, photos, branding) belongs to Apex or its licensors and may not be copied for commercial use without permission.

4. Tours, free week trial, and becoming a member

Tours and free week trial

Our public website states that we offer a free week trial for any new member and invites you to contact us to set up a tour. Trial availability, length, and what’s included (classes, open gym, etc.) are confirmed when you schedule with us. Trials may require:

  • Contact information and scheduling

  • A liability waiver and any house-rules acknowledgment before training

  • Proof of identity if we reasonably request it

A trial does not guarantee a particular membership rate, coach, or class slot beyond what we confirm in writing or at signup.

Memberships and pricing

Our Pricing page describes current options and states that we believe in transparent pricing with no long-term contracts or added fees, and that we want you to stay because you want to. Posted prices, punch-card expirations, and package details on the website are informational and may change. The rate and terms that apply to you are those:

  • Shown at the time you purchase or renew, and/or

  • Confirmed in your membership agreement, invoice, or payment receipt

We do not invent additional legal guarantees beyond what is publicly stated and what you agree to at purchase. Special programs (for example Foundation tiers) have their own stated benefits and prices.

No long-term contracts (as publicly stated)

Consistent with our public Pricing page, standard memberships are generally offered without long-term contracts. Cancellation, freeze, and billing timing follow the policy we give you at signup (and any written updates we provide). Contact jeff@apexgymnv.com or (775) 412-8538 to cancel or change a membership. You remain responsible for charges incurred before cancellation takes effect under that policy.

5. Payments, punch cards, and refunds

  • Payments are processed through our payment providers. You authorize recurring charges if you enroll in a recurring membership.

  • Punch cards and session packs expire as stated at purchase (for example, the expirations listed on our Pricing page). Unused sessions after expiration are generally non-refundable unless Nevada law or a written Apex policy requires otherwise.

  • Drop-ins and single sessions are typically non-refundable once used.

  • Refunds for unused membership time, trials, or merchandise are handled case-by-case under the policy communicated at purchase, or as required by law. Contact us promptly with billing questions.

6. Facility rules, safety, and assumption of risk

Fitness training, weightlifting, CrossFit-style workouts, HYROX, strongman, open gym, and sauna use involve inherent risks of injury, illness, property damage, or death.

By using Apex facilities or services you agree that:

  • You will follow staff instructions, posted rules, and equipment safety practices

  • You will not train under the influence of alcohol or impairing substances

  • You are responsible for knowing your own limits and informing coaches of relevant injuries or conditions you choose to disclose

  • You will complete any required liability waiver before participating; training may be refused without a signed waiver

  • After-hours / 24-hour access (if provided) is a privilege; misuse, unsafe behavior, or sharing access credentials can result in immediate suspension

Assumption of risk: To the fullest extent allowed by Nevada law, you voluntarily assume the risks of participating in physical training and using the facility and sauna.

This website Terms page does not replace your signed gym waiver or membership agreement. If there is a conflict on liability or release language, the signed waiver/membership documents control for in-gym participation.

7. Personal training and coaching

Personal training and coaching sessions are subject to scheduling rules, late-cancel / no-show policies, and package expirations we communicate at booking. Results vary; Apex does not guarantee specific performance, competition, or body-composition outcomes.

8. Sauna use

Sauna use is at your own risk. Do not use the sauna if you have medical conditions that make heat exposure unsafe, if you are pregnant (unless cleared by your physician), or if staff advise against it. Follow time limits and posted rules. Exit immediately if you feel dizzy, nauseated, or unwell.

9. Conduct and termination

We may refuse service, suspend access, or terminate membership for conduct that is unsafe, harassing, discriminatory, illegal, or harmful to the community—including sharing 24-hour access, damaging property, or violating these Terms. You remain responsible for amounts owed through the effective termination date under your billing terms.

10. Email and SMS (text) communications

By providing your phone number or email and opting in where consent is requested, you agree that Apex may contact you about tours, trials, memberships, scheduling, and (if you opt in) marketing.

  • SMS: Message frequency varies. Message and data rates may apply. Reply STOP to opt out of marketing texts; reply HELP for help.

  • Email: Marketing emails include an unsubscribe link.

Consent to marketing is not a condition of purchasing services, except where a communication is necessary to deliver a service you requested.

11. Intellectual property and media

Apex name, logos, and site content are protected. You may not use them commercially without written permission.

If you appear in photos or videos at the gym, we will seek appropriate consent before featuring you in marketing when practicable. You may ask us not to use your image by emailing jeff@apexgymnv.com.

12. Disclaimers

THE WEBSITE AND SERVICES ARE PROVIDED “AS IS” TO THE FULLEST EXTENT PERMITTED BY LAW. APEX DOES NOT WARRANT UNINTERRUPTED ACCESS, ERROR-FREE WEBSITE OPERATION, OR SPECIFIC FITNESS RESULTS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS; IN THOSE CASES, DISCLAIMERS APPLY ONLY TO THE MAXIMUM EXTENT ALLOWED.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY NEVADA LAW, APEX TRAINING LLC AND ITS OWNERS, COACHES, EMPLOYEES, AND AGENTS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM WEBSITE USE OR SERVICES. OUR TOTAL LIABILITY FOR CLAIMS ARISING FROM THE WEBSITE (NOT INCLUDING CLAIMS GOVERNED BY A SIGNED WAIVER) IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID APEX IN THE THREE MONTHS BEFORE THE CLAIM OR (B) $100.

Nothing in these Terms limits liability that cannot be limited under applicable law (including certain personal-injury claims where prohibition is not allowed).

14. Indemnity

You agree to indemnify and hold harmless Apex Training LLC and its owners, coaches, and staff from claims arising out of your misuse of the website, violation of these Terms, or your breach of law—except to the extent caused by Apex’s gross negligence or willful misconduct, or as limited by a signed waiver’s terms and Nevada law.

15. Governing law and disputes

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law rules. You agree to attempt to resolve disputes informally by contacting jeff@apexgymnv.com first. If unresolved, exclusive venue lies in state or federal courts located in Washoe County, Nevada, unless a signed membership agreement or waiver specifies otherwise.

16. Changes

We may update these Terms by posting a revised version on this page and updating the “Last updated” date. Continued use of the website or services after changes means you accept the revised Terms, except where additional consent is required by law (for example for certain marketing practices).
